Рефлексия по поводу несостоявшегося теракта в Виктории

Телевизор в доме террористов больше похож на игрушку в сумасшедшем доме
Несостоявшийся теракт в сердце Виктории у здания Парламента канадской провинции Британская Колумбия во время празднования Дня Канады первого июля 2013 года заставил задуматься о причинах и следствиях этого события.

Как уже много писалось в СМИ, в том числе и в российских, двое канадцев – тридцатилетняя женщина и тридцатидевятилетний мужчина – прониклись идеями террористической организации Аль-Каеда и решили организовать «свой» теракт. Момент и место для него были выбраны очень сознательно: у здания Парламента в День Канады собирается особенно много народа. К вечеру в предвкушении фейерверка там обычно реально негде яблоку упасть. Преобладает молодежь. Террористы начинили бомбу ржавыми гвоздями, болтами, железными шайбами и другой металлической  мелочью. Взорванная в такой момент такая бомба могла унести и искалечить много молодых жизней и нанести максимальный удар по обществу. Полиция «вела» террористов уже некоторое время и решила арестовать их практически в день совершения преступления.

Почему же жителями расслабленного западного берега Канады приходит в голову желание сделать что-то подобное? Террористы не были эмигрантами-неудачниками вроде братьев Царнаевых, которые организовали взрыв во время Бостонского марафона в апреле 2013 года. Царнаевы не смогли или не захотели встроиться в новое общество. Террористы из Виктории же (на самом деле они из пригорода Ванкувера под названием Сюррей) являются коренными канадцами. Полиция заявляет, что они «само-радикализовались», начитавшись фундаменталистской литературы и веб-сайтов.

Сдается мне, что еще русской классик Достоевский описал в бессмертных «Братьях Карамазовых» то, что произошло. Иван Карамазов бросает радикальные идеи, а «ублюдок» Смердяков берет их себе на вооружение и совершает непосредственное убийство. Террористы из Виктории являются теми самыми Смердяковыми –  ограниченными, необразованными людьми, уязвимыми к наиболее разрушительным идеям, со своей логикой, которая оправдывает любую подлость и злодеяние. К сожалению не только их разум был отравлен, но и у них нашлось достаточно силы воли, чтобы приступить к действиям. Сейчас террористам придется отвечать за свои действия по всей строгости закона, который наверняка будет к ним очень суров.

Следователи также выяснили, что на своей страничке в социальных сетях один из террористов публиковал стихи сатанинского содержания. Это означает, что радикальные идеи, которыми прониклись террористы, несли в себе и романтическую составляющую в виде прославления бунтарских страстей.

С одной стороны радикальные и бунтарские идеи не запретишь и цензурой их не закроешь. С другой стороны, террористы каким-то образом узнали, как построить настоящую бомбу. Я не большой сторонник цензуры, но может действительно стоит закрывать некоторые подобные публикации!

Большое спасибо полиции Виктории и канадским спецслужбам, которые предотвратили этот теракт! Я не знаю, как они смогли «вести» это дело – возможно какую-то роль сыграло глобальное прослушивание телефонных разговоров и перехват электронных сообщений. Именно этот процесс недавно с такой помпой раскрыл Эдвард Сноуден. Я рад, что террористов поймали, и если для этого использовали технологии массового слежения – значит так тому и быть! Может эта слежка нарушает права человека, но она и спасает жизни! Вот такой выбор нам предоставляет современность, выбор непростой, но на мой взгляд весьма очевидный!

Так что казус Сноудена скорее всего потерпел серьезное поражение в минувший выходной. Это событие имеет важные и далеко идущие последствия для всей той части мира, которая считает себя демократической. Правозащитникам теперь будет еще труднее противостоять электронной глобальной слежке, а силовым структурам будет проще осуществлять ее. То, что считалось нарушением прав человека вчера, будет считаться необходимостью во благо народа завтра. Акценты продолжат меняться, перемещаясь с частных свобод на общественное благоденствие. Мир продолжит развиваться по израильскому сценарию – демократии на военном положении.

Слишком видимо мы все разные, чтобы нам вместе жить в мире и согласии. Утопию пока построить не удается. Смысл современного демократического развития будет заключаться в том, чтобы избежать анти-утопии.

    Не смотрела сама никакую информацию по этому поводу, верю тебе.
    Но я лично далеко не во все "теракты" верю. Слишком часто это становится только инструментом и поводом для завинчивания политических гаек. И опять же после всей этой истории со Сноуденом так вовремя этот теракт, так удобно припугнуть людей террористами, чтобы они сами отказались отстаивать свою свободу. Ах, пожалуйста, да заберите вы эту свободу, только защищайте нас от "террористов"! У Достоевского люди меняли свободу на хлеб. Сейчас свободу отдают за безопасность. И как у Достоевского (правда, в "Бесах", не в "БК") предполагалось периодически, раз в 10 лет "пускать волну", чтобы народ не расслаблялся и не переставал верить в благостность людей, отнявших у них свободу, так и сейчас время от времени на сцену выходят "террористы". Вон как долго "не могли поймать" Бен Ладена. А зачем? Такая удобная фигура. Чуть что - помните о Бен Ладене, дорогие? Так что вы уж не возмущайтесь, когда мы сейчас еще одну контролирующую штучку вам придумаем, чтобы вы шагу не могли ступить без нашего ведома.
    Знаешь, это разные вещи: соглашаться (или не соглашаться) на то, чтобы твою переписку просматривали из соображений безопасности, и узнать о том, что это делали без твоего ведома. Я вот, пожалуй, и не согласилась бы...

    1. Мысли, которые ты высказываешь, очень распространены - даже я бы сказал поразительно широко распространены. Однако одно дело рассуждать о предотвращенном теракте издалека, и совсем другое "ощутить взмах черного крыла смерти" совсем рядом. У меня нет оснований подозревать полицию Виктории в подставе, а за то что они предотвратили жуткую трагедию прямо у меня под носом - им большое спасибо, и как бы они на это дело не вышли - я за все им благодарен!

  3. Канаду "невозможно запугать", заявил канадский премьер-министр Стивен Харпер в телеобращении к нации после нападения на парламент страны.

    В среду вооруженный человек застрелил гвардейца у военного мемориала в Оттаве, а затем проник в парламент, где был убит в перестрелке с полицией.

    Харпер назвал нападавшего террористом и пообещал удвоить усилия по борьбе с терроризмом. "В ближайшие дни мы выясним подробности касательно этого террориста и его сообщников, если таковые имелись", - добавил он.

    "Это лишь заставит нас усилить решимость и удвоить наши усилия, чтобы мы могли предпринять все необходимые шаги для выявления потенциальных угроз и борьбы с ними ради сохранения безопасности в Канаде", - сказал премьер.

    Стивен Харпер также признал, что случившиеся в последние дни вооруженные нападения показали, что страна "не защищена от террористических угроз", но подчеркнул, что злоумышленники "не смогут найти укрытия в Канаде".

  4. John Nuttall, Amanda Korody planned a Canada Day bombing as 'terrorist cell,' says Crown

    The Crown alleges the B.C. couple accused of plotting to bomb the B.C. Legislature on Canada Day in 2013 wanted to kill people, and compared their plan to the Boston Marathon bombings and Sept. 11 attacks.

    Amanda Korody and John Nuttall placed two pressure-cooker bombs in two places on the front lawn of the legislature in Victoria, said Crown counsel Peter Eccles in his opening arguments Monday.

    They did this "for the benefit of their homegrown two person terrorist cell," said Eccles.

    "Two people can be a terrorist group. We don't say they are members of al-Qaeda. We don't need to prove that to prove they are terrorists," he said.

    Nuttall and Korody, on trial before a jury in B.C. Supreme Court in Vancouver, have pleaded not guilty to charges of knowingly facilitating a terrorist activity, conspiracy and making or possessing an explosive device.

    The pair, in their 30s, were arrested at their Surrey home in July 2013 after police seized the pressure-cooker bombs on the grounds of the legislature on Canada Day.

    A jury heard the Crown describe its case against the couple, which is largely based on surveillance videos and wiretap conversations.

    Over months, Nuttall got to know an undercover officer posing as an Arab businessman who was sympathetic to jihadist movements.

    In June 2013, Nuttall gave the man plans for a hand-drawn bomb that was the same as the type used in the Boston Marathon bombing, according to Eccles.

    He told the officer he wanted to build a bigger and better one, because "Boston only killed eight people," according to the Crown.

    Outside court, Nuttall's mother, Maureen Smith, told reporters her son and his girlfriend were being made an example of by the federal government.

    "The Canadian government wants everyone so they can have more control over the people and say, 'Oh look, we're doing our job, look at these terrorists,'" said Smith.

    She described Nuttall and Korody as "very genuine" with "serious disabilities."

    "They're two of the sweetest people you could ever meet in your life," she said.

    The trial is expected to last several weeks.

    Many details of the allegations against Korody and Nuttall are covered by a publication ban.

  5. VANCOUVER — There is evidence the RCMP broke the law while conducting a terrorism sting and they must hand over confidential legal documents, says a B.C. Supreme Court judge.
    Justice Catherine Bruce has not yet ruled on whether the RCMP entrapped John Nuttall and Amanda Korody into plotting to blow up the B.C. legislature in 2013, but she said in a ruling released Wednesday that the Mounties may be guilty of knowingly facilitating a terrorist act.
    “In my view, the defence have raised at least a prima facie case that the RCMP officers involved in Project Souvenir were engaged in unlawful acts during the undercover operation,” wrote Bruce, referring to the operation by its code name.
    “There is a sufficiently close link between the illegal acts committed by the RCMP and the prosecution of the accused to support an abuse of process claim.”
    Nuttall and Korody were found guilty earlier this year of planning to detonate homemade pressure-cooker explosives on the grounds of the provincial legislature during Canada Day celebrations two years ago.
    Their lawyers are asking the court for a stay of proceedings for reasons of entrapment, arguing the RCMP manipulated the pair into carrying out the bomb plot, which they say would never have happened without extensive help from the police.
    Over the course of the investigation, undercover officers posing as jihadi warriors gave Nuttall and Korody groceries, cigarettes, bus passes, cell phones, phone cards, clothing, cash and a portable hard drive.
    They also provided the pair with a place to work on their terrorist scheme and a location to build the explosives, chauffeured them to various stores to purchase bomb-making equipment and transported them to and from Victoria and around the Lower Mainland over the course of the four-month sting operation.
    Bruce’s ruling ordered the police to disclose confidential legal advice they received about running the undercover affair, but added that she would vet the documents before releasing them to the defence.
    Communication with a lawyer is normally protected under solicitor-client privilege, but Bruce said the Mounties waived that right by willingly disclosing a portion of that information in court.
    “These disclosures were not only contained in officers’ notes, but were included in the minutes of the briefing meetings held by the command team and the undercover [operators]. These meetings were attended by the highest ranking officers involved in Project Souvenir,” Bruce wrote.
    “They provided key insight into the state of mind of all the officers involved in the undercover operation.”
    The ruling revealed that lawyers had advised the RCMP on numerous occasions, including recommending officers “drive target but don’t shop” when purchasing materials to build the explosives.
    While finding that the police acted illegally may not be enough to warrant an acquittal, evidence that the police ignored legal advice relates to “the seriousness of their misconduct” and is relevant to whether a stay of proceedings should be ordered, Bruce wrote in her ruling.
    Whether the Mounties followed the legal advice matters because it may show the officers acted in bad faith, she said.
    Bruce noted that the Crown had not objected to some legal advice being disclosed before the court, so she ruled that to allow prosecutors to rely selectively on otherwise-confidential legal opinions would “give the Crown an unfair advantage.”

  6. 'Manufactured crime,' lawyer says


    Last year, Nuttall and Korody were found guilty by a jury of conspiring to murder persons unknown and making or possessing an explosive substance for planting pressure-cooker bombs outside the B.C. Legislature in 2013.

    Both were facing a sentence of life in prison.

    But Friday, B.C. Supreme Court Justice Catherine Bruce entered a stay of proceedings and released them.

    Defence lawyers had called it a "manufactured crime."

    The judge ruled that Nutall and Korody were entrapped by RCMP. She said police went too far and used trickery and subterfuge to manipulate the pair.

    The judge also said the couple did not have the mental capacity to have planned and carried out the bomb plot themselves.

  7. After the Canada Day “terrorist” bomb threat at the B.C. legislature in 2013 broke, there was an extended debate about whether the defendants were real terrorists, or just village idiots.
    Regardless of the definition, the striking thing about the case was the hundreds of schoolkids who were on the grounds that day. Whatever the motivation for the planting of the supposed bomb, the chilling prospect of someone even contemplating anything that would have left those children killed or maimed made people’s blood run cold.
    But the serious fades upon reading the Supreme Court verdict that found John Stuart Nuttall and Amanda Marie Korody were entrapped by the RCMP, so the charges against them are stayed.
    The ruling on the absurd case from Justice Catherine Bruce is more like a black comedy leading up to the punchline at the end — it was the RCMP who did most of the law-breaking. Undercover police spent months babysitting Nuttall and listening to his lunatic fantasies about stealing nuclear submarines or storming CFB Esquimalt. The wannabe jihadist ran his mouth off for months on end to a Muslim undercover cop. But he was incapable of actually doing anything.
    While the brass in Ottawa pressed for progress, the team grew impatient. They were trophy-hunters looking for a big terrorist bust, so they steered their basket case of a suspect to more achievable goals, then helped make them happen. They crossed every one of the entrapment lines drawn in law, despite having an eminent lawyer supposedly advising them every step of the way. The police team was conscious of the crucial entrapment issue, talked about it constantly, but still managed to blunder into it.
    The judge said Nuttall’s ideas were “grandiose and fanciful,” and he proved himself over and over again to be completely incapable of planning or executing anything. He couldn’t even kill the ants in his basement suite without poisoning himself with strychnine.

  8. (He was temporarily blinded and paralyzed, but didn’t call 911 because he felt Muslims can’t seek help from anyone who mocks the religion. He was so dependent on the Mountie by that point, six weeks before the bomb was planted, that he called him twice for advice on whether to get medical help.)
    Reviewing months of surveillance and dealings with him, including two all-expense-paid trips for the pair to Kelowna and Whistler for planning purposes, the justice said there was ample evidence of Nuttall’s “general ineptitude, scatterbrained character, inability to think logically, his child-like demeanour and inability to remained focused.” Earlier, a psychiatric nurse had suggested he is developmentally delayed.
    Urged by the undercover team to put together a coherent plan, so they could finally charge him, he was incapable of coming up with anything.
    They eventually decided to try to focus him, and the idea of targeting the legislature was hatched. Police had to chauffeur them around for three ridiculous days buying bomb supplies, rent the couple a motel suite, beg them to stop playing video games, coach them all the way through the bomb assembly process and maintain their methadone doses and prescriptions. (Korody spent much of that period asleep or sick.)
    “Without the police, it would have been impossible for the defendants to carry out the pressure-cooker plan,” said the judge. Undercover police even constructed the devices, fixing the botch Nuttall had made of them, and transported them to Victoria. Police put them up in a motel, drove them around town scouting locations, coached them on a target, then took them back to the mainland.
    “This is truly a case where the RCMP manufactured the crime,” said the judge. They didn’t break up a specific terrorist plot. They weren’t infiltrating a terrorist organization. The couple was not in touch with known terrorists.
    Bruce said police were overzealous and acted as if there are no limits to what’s acceptable with investigating terrorism. Pending appeal, the upshot of the case is the startling degree of ineptitude in recognizing what entrapment is, given that it was obviously going to be a major issue in the case right from the start.
    A better legacy would be some kind of approach to treating lone-wolf haters like Nuttall that involves some simple common sense.

  9. An alleged terrorist plot in Ontario that created anxieties over police monitoring of suspects hasn't shaken Prime Minister Justin Trudeau's emphasis on balancing civil liberties with public safety.

    In his first reaction to an alleged plot that led to the death of Aaron Driver in Strathroy, Ont., Trudeau said Tuesday that balancing individual rights with keeping Canadians secure from bombing threats has to be handled with care.

    "Canada is a country that values its freedom (and) its basic charter rights," he said during a stop in Bridgetown, N.S., for an infrastructure announcement.

    "All Canadians expect their government to do two things: to keep Canadians safe and to defend and uphold the values and rights that all Canadians hold dear."

    "Getting that balance right isn't always easy in the challenging situation we now live in but it's extremely important."
    Last week, the RCMP fielded media questions about why it was the FBI and not the Mounties who discovered a video that led them to Driver, who police said had threatened to detonate an explosive in an urban centre. Trudeau was asked the same question Tuesday but did not answer directly.

    Driver died Wednesday night after a confrontation with police that saw a bomb detonated in a taxi cab.
